OPEN SKILLS ACADEMY – TERMS OF USE

Welcome to Open Skills. By accessing our platform, you (the “User”) agree to these Terms.
1. ACCESS & SECURITY
- Individual Use: Your login is for you only. Sharing credentials with colleagues or friends is strictly prohibited and may result in immediate account suspension.
- Accuracy: You agree to provide truthful information during registration. Certificates will be issued in the name provided at signup.
- Device Security: You are responsible for the security of the mobile device or computer used to access the platform.
2. INTELLECTUAL PROPERTY & RESTRICTIONS
The “Open Skills” environment, including its layout, the Instructor Manual, and all course structures, are protected property.
- No Downloading: Unless a “Download” button is explicitly provided, you may not record, screen-grab, or “rip” video and text content.
- No Scraping: Use of automated bots to harvest data or content from this platform is strictly forbidden.
- No Derivative Works: You may not use our course structures to build a competing platform.
3. INSTRUCTOR CODE OF CONDUCT
If you have Instructor or Contributor access:
- Originality: You warrant that all uploaded materials (PDFs, Videos, Images) are your original work or that you have the legal right to use them.
- Prohibited Content: You may not upload content that is defamatory, infringing on copyright, or violates the laws of the Republic of Botswana.
- Reporting: You agree to monitor student progress ethically and report any platform bugs via the Instructor Dashboard.
4. DATA PRIVACY (BDPA COMPLIANCE)
- What we collect: We track login times, course progress, quiz scores, and IP addresses to improve your learning experience and verify certifications.
- Third Parties: Your progress data is shared with the Client Company (your employer or sponsoring organisation) as part of their training reporting.
- Security: We use secure, cloud-based hosting. While we apply high-level encryption, no internet-based system is 100% immune to risks.
5. MOBILE DATA & CONNECTIVITY
- Data Charges: Open Skills is optimised for low data usage, but you remain responsible for all mobile data or internet costs incurred while using the platform.
- Offline Access: If you use “Offline Mode” (where available), ensure your device has sufficient storage.
6. DISCLAIMERS & LIMITATION OF LIABILITY
- “As-Is” Service: The platform is provided without a guarantee of 100% uptime. Maintenance may occur periodically.
- No Professional Warranty: Unless specifically stated, completing a course does not grant a government-recognized license.
- Liability: Open Skills shall not be liable for any data loss, device damage, or indirect damages arising from your use of the platform.
7. TERMINATION
We reserve the right to suspend or terminate any account that violates these terms, engages in cheating, or attempts to compromise the platform’s security.
